Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Withdrawal Period: the time period during which the customer may cancel an order as permitted by law.
  • Consumer: any individual who purchases goods or services for personal use and not for commercial purposes.
  • Business Day: any calendar day excluding weekends and public holidays.
  • Subscription Contract: a distance contract covering a series of products and/or services delivered or supplied over time
  • Durable Medium: any instrument that allows the customer to store information personally addressed to them, for future reference, and reproduction without alteration.
  • Right of Withdrawal: the right of the customer to cancel the purchase within the withdrawal period.
  • Seller: the natural or legal person who offers products and/or services remotely to consumers.
  • Distance Contract: any agreement concluded between the seller and the consumer under an organized system for remote sales using one or more distance communication methods.
  • Means of Distance Communication: any method that allows a contract to be concluded without the simultaneous physical presence of the parties.
  • Terms and Conditions: the present general conditions of the seller.

Article 3 – Scope of Application

These Terms and Conditions apply to all offers, orders, and distance contracts concluded between the seller and the consumer.
Before completing a purchase, the text of these Terms and Conditions will be made available to the customer.

If the contract is concluded electronically, the Terms and Conditions may also be provided electronically (for example, via email) in a format that allows the customer to store and reproduce them.

If any specific product or service conditions conflict with these general Terms, the most favorable provision to the consumer shall prevail.

If one or more provisions of these Terms are found to be invalid or unenforceable, the remaining provisions shall continue in full force. The invalid clause will be replaced by a valid one that best matches the intent of the original.

Situations not covered by these Terms shall be interpreted in accordance with their spirit and purpose.

 

Article 4 – Offer

The offer contains a complete and accurate description of the products and/or services provided. Obvious errors or mistakes in the offer do not bind the seller.

All images, specifications, and product information are indicative and may not serve as a basis for claims or contract cancellation.
Product photos represent the items offered as accurately as possible, but exact color reproduction cannot be guaranteed.

Each offer clearly specifies the rights and obligations of the customer, including but not limited to:

  • The total price, including all applicable taxes

  • Any shipping costs

  • The steps required to finalize the purchase

  • The existence or absence of the right of withdrawal

  • Payment, delivery, and performance terms

  • The validity period of the offer and/or price

  • Any additional communication costs differing from standard rates

  • Any authorizations applicable to the seller

  • The conditions for contract termination by the consumer

  • Available contract languages (in addition to English)

  • Codes of conduct the seller adheres to and how the customer may consult them

  • The minimum duration of the contract in the case of continuous or subscription transactions

Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and meets the stated conditions.
When the consumer accepts the offer electronically, the seller will promptly confirm receipt of the acceptance. Until confirmation has been sent, the consumer may withdraw from the agreement.

When a contract is concluded electronically, the seller will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe online environment.
If online payment options are provided, the seller will implement reasonable security measures to protect those transactions.

 

Article 6 – Governing Law

These Terms are governed by the laws of The Netherlands, applicable to international online sales.
